ADA Complaint and Grievance Form
The purpose of the Grievance Procedure is to provide an avenue for any member of the public to make an accessibility problem or concern known to the Town and to facilitate the prompt and equitable resolution of complaints alleging any action that would be prohibited by the Americans with Disabilities Act. The form may be used to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs or benefits of the Town. The Grievance Policy is as follows:
Step 1: File a Grievance Form
The Grievant should fill out the ADA Complaint/Grievance Form, giving all of the information requested. The ADA Complaint/Grievance Form should be filed in writing with the Town Clerk within sixty (60) days of the alleged disability-related discrimination. Upon request, reasonable accommodation will be provided in completing the form, or alternative formats of the form will be provided. The Form may be obtained from and sent to the Town of Mammoth Lakes' Clerk.
Step 2: An Investigation is Conducted
A notice of receipt shall be sent to the Grievant within five days of the receipt of the complaint or grievance. If necessary, the authorized Town representative may contact the Grievant directly to obtain additional facts or documentation relevant to the grievance. If the Grievant does not wish to be contacted personally, it should be indicated on the grievance form.
Step 3: A Written Decision is Prepared and Forwarded to the Complainant
A written decision shall be prepared after full consideration of grievance merit and sent back to the Grievant no later than thirty (30) days following the receipt of the grievance. A copy of the written decision shall be mailed to the Grievant by registered mail or email no late than five (5) days after the preparation of the written decision.
Step 4: A Complainant May Appeal the Decision
If the Grievant is dissatisfied with the written decision, the Grievant may file a written appeal with either the Town Manager or designee, no later than thirty (30) days from the date of the mailing of the decision. The appeal must contain a statement explaining the reasons why the Grievant is dissatisfied with the written decision, and must be signed by the complainant, or by someone authorized to sign on the complainant's behalf. A notice of the receipt shall be mailed to the complainant by registered mail within five (5) days of the receipt of the appeal. The decision of the Town Manager or designee shall be final.
The Town of Mammoth Lakes Staff shall maintain the confidentiality of all files and record relating to grievance file, unless disclosure is authorized or required by law. Any retaliation, coercion, intimidation, threat, interference, or harassment for filing of a grievance, or used to restrain a grievant from filing, is prohibited and should be reported immediately to the Town Clerk.
